Lehman-Brothers-Related Products Dispute Mediation and Arbitration Scheme

To facilitate settlement of dispute between investors and distributing banks relating to Lehman-Brothers-related products, the HKMA has engaged the Hong Kong International Arbitration Centre (HKIAC) to make available mediation and arbitration services under the Lehman-Brothers-related Products Dispute Mediation and Arbitration Scheme ("the Scheme").

The Scheme is open to investors who have made complaints to the Hong Kong Monetary Authority and whose complaints have been referred to the Securities and Futures Commission for it to decide whether to take any further action or where a finding against a relevant individual or an executive officer of a bank has been made. The HKMA will inform the investors who are eligible for the Scheme in writing.

Since mediation and arbitration are voluntary dispute-resolution mechanisms, the consent of both the complainants and the bank is required before they can proceed.

For those who are not eligible for the Scheme, the Hong Kong International Arbitration Centre offers a similar service using the same procedures as those applicable to the Scheme. You and your bank will have to pay a fee for this service. You should contact your bank to see if it is willing to take part.
